This document includes our Product Use Terms, Disclaimer & Waiver (Sections 1 to 13) and our Conditions of Sale (Sections 14 to 22). Sections 5 and 8 below are highlighted accordingly as they contain important provisions that limit our liability and require you to voluntarily assume certain risks. By checking the acknowledgement box at checkout you confirm that these provisions were drawn to your attention before purchase, that you have read and understood them, and that you are at least 18 years of age.
Part A. Product Use Terms, Disclaimer & Waiver
1. What this product is
The CannagarZA cannagar mould is a 3D-printed PLA (polylactic acid) plastic accessory designed to assist a competent adult user in shaping plant material into a rolled, cigar-shaped product for personal use. It is sold as a hobbyist rolling aid only. It is not a medical device, contains no active substances, and makes no therapeutic, health, wellness or curative claims of any kind.
2. Age and capacity
This product is sold strictly for use by persons aged 18 years and older. By purchasing, accepting delivery, or using the product, you warrant that you are at least 18 years of age and have full legal capacity to enter into this agreement.
3. Intended use and user responsibility
You are solely responsible for what you place into, shape with, or consume from any item produced using this mould. CannagarZA does not supply, recommend or endorse any specific substance, herb, plant or material that may be used with the mould. Lawful use of the mould and any material used with it is entirely the buyer’s responsibility and must comply with all applicable laws of the Republic of South Africa and any jurisdiction in which the user resides.
In particular, the user acknowledges that South African cannabis legislation, including the Cannabis for Private Purposes Act and related Constitutional Court rulings, permits adult private use within prescribed limits, while the commercial trade in cannabis remains restricted. Compliance with these limits and with any other applicable laws is the user’s responsibility.
4. No medical or therapeutic claims
Nothing produced by CannagarZA, including this document, the product packaging, the website, social media, or any communication, constitutes medical advice, therapeutic claim, or health recommendation. The product has not been evaluated, registered, approved or certified by the South African Health Products Regulatory Authority (SAHPRA) or any equivalent body, and is not represented as a medicine, medical device, complementary medicine or health product.
5. Inherent risks and assumption of risk
The user expressly acknowledges that the activity of rolling, lighting and inhaling combustion products of any plant material carries inherent and material risks to health, including but not limited to respiratory irritation, lung damage, cardiovascular impact, cognitive impairment, dependency, fire and burn injury, and other adverse outcomes. Smoke from burning plant material is harmful. The user assumes all such risks voluntarily and unconditionally upon use of the product, and acknowledges that this assumption of risk was drawn to the user’s attention before purchase via the checkout acknowledgement on this website.
6. Product care, hygiene and safety
The mould is manufactured from PLA, a thermoplastic with a glass transition temperature of approximately 60 °C and a melt range of approximately 170 to 220 °C. The 3D-printing process produces microscopic layer lines and crevices in the printed surface where plant matter, moisture and bacteria can become trapped. The mould is a forming tool only and is not intended for the long-term storage of any consumable material. To preserve the integrity of the mould, to maintain hygiene, and to protect the user, the following instructions apply:
- Do not apply direct flame, lit material or any heat source to the mould.
- Do not place the mould in a microwave, oven, dishwasher or any heated environment.
- Keep the mould out of direct sunlight and out of hot motor vehicles.
- Clean the mould before and after each use with a damp cloth and mild soap, then dry thoroughly. Do not leave damp plant residue on or inside the mould.
- Do not store any consumable material inside the mould. The mould is a forming aid, not a storage vessel. The user is solely responsible for maintaining hygiene to prevent bacterial or fungal growth.
- The mould assembly consists of multiple separable plastic parts. Keep all components, packaging and any included accessories out of reach of children and pets to prevent choking, ingestion or injury.
- Replace the mould if it shows cracks, deformation, discolouration, persistent residue or any sign of degradation.
CannagarZA accepts no responsibility for any injury, illness, damage, loss or product failure resulting from use that does not comply with these care, hygiene and safety instructions.
7. Warranty
Other than the implied warranty of acceptable quality provided by the Consumer Protection Act 68 of 2008 (CPA), no further warranty is given. The product is supplied “as is”. CannagarZA does not warrant that the mould will produce any particular result, suit any particular purpose other than its general design purpose, or be compatible with any particular plant material, rolling paper or technique used by the buyer.
8. Limitation of liability and indemnity
To the maximum extent permitted by law (including section 61 of the CPA and the common-law principles governing voluntary assumption of risk), the following provisions limit our liability and require an indemnity from the buyer. These provisions were drawn to the buyer’s attention before purchase via the checkout acknowledgement on this website:
- CannagarZA, its owner, employees, contractors and suppliers shall not be liable for any direct, indirect, incidental, consequential, special or punitive damages, including loss of profit, loss of use, personal injury, illness, death, property damage, fire damage, legal costs or any other loss, arising from the use, misuse, malfunction or failure of the product, save where such liability cannot lawfully be excluded.
- The buyer indemnifies and holds harmless CannagarZA against any third-party claim, demand, action, fine, penalty or cost arising from the buyer’s use of the product, including any unlawful, negligent or reckless use.
- Where statutory liability cannot be excluded, the total aggregate liability of CannagarZA in respect of any single product is limited to the original purchase price paid for that product.
9. Returns, refunds and defects
Returns and refunds are governed by the Conditions of Sale in Part B below. In summary:
- Unused, unopened product in original condition may be returned within 7 days of delivery for a full refund less return shipping cost.
- Used product may not be returned for hygiene reasons.
- Genuine manufacturing defects discovered within the CPA implied warranty period (6 months) will be repaired, replaced or refunded at the buyer’s election. Photographic evidence is required.
- Damage caused by misuse, heat exposure or non-compliance with the care instructions in Section 6 is not a manufacturing defect and is excluded from the warranty.
To initiate a return, email info@cannagarza.co.za with your order number and reason. Do not return product without prior written authorisation.
10. Privacy
Personal information collected to fulfil your order is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and the Privacy Policy. Information is used only for order fulfilment, customer service and, with consent, marketing communication, and is not sold to third parties.
11. Governing law and jurisdiction
This agreement is governed by the laws of the Republic of South Africa. Any dispute shall be subject to the non-exclusive jurisdiction of the South African courts.
12. Severability and entire agreement
If any provision of this document is found to be unenforceable or invalid, that provision is severed and the remaining provisions continue in full force. This document, together with the Privacy Policy, constitutes the entire agreement between the buyer and CannagarZA. No verbal undertaking, social-media post or third-party representation forms part of the agreement unless reduced to writing and signed by CannagarZA.
13. Intellectual property
The CannagarZA name, logo, branding, product designs, 3D model files, and the specific physical form and geometry of the cannagar mould (including all sizes and variants) are the intellectual property of CannagarZA. Purchase of this product grants the buyer a personal, non-transferable right to use the physical product for its intended purpose only. Purchase does not grant, and CannagarZA expressly does not authorise, the buyer to cast, mould, scan, photograph for reproduction, 3D-scan, digitally reproduce, reverse-engineer or manufacture copies of the product, or any part of it, for resale, distribution, or any commercial purpose. Digital STL/3MF design files purchased from our Cults3D page are licensed for personal use only. Unauthorised reproduction will be pursued to the fullest extent of South African intellectual property law, including the Copyright Act.
Part B. Conditions of Sale
14. Orders and acceptance
By placing an order, you make an offer to purchase the products in your cart. CannagarZA reserves the right to accept or decline any order. The contract of sale is formed when CannagarZA confirms acceptance of your order by email.
15. Payment
Payment is accepted via Electronic Funds Transfer (EFT) only. Your order will be processed once payment has been received and confirmed in our bank account. Proof of payment must be emailed to info@cannagarza.co.za with your order number as the reference.
16. Pricing
All prices are in South African Rand (ZAR) and include VAT where applicable. Shipping costs are additional and will be calculated at checkout. CannagarZA reserves the right to change prices at any time without prior notice; any change does not affect an order that has already been confirmed.
17. Manufacturing and dispatch
All products are made to order using 3D printing technology. Standard dispatch time is 3 to 5 business days from receipt of payment confirmation. During peak periods, dispatch times may be extended; CannagarZA will notify you if this applies to your order.
18. Shipping and delivery
We ship within South Africa only via The Courier Guy. Shipping options are R99 (standard, 1 to 3 business days) or R150 (priority, 1 to 2 business days). Orders over R1 000 qualify for free standard shipping. We are not responsible for delays caused by the courier service.
19. Risk and ownership
Risk of loss or damage to products passes to the buyer upon delivery. Ownership passes upon receipt of full payment by CannagarZA.
20. Returns and refunds
Refunds will be processed once any returned item is received and inspected. Refunds are issued to the original payment method (EFT). Shipping fees are non-refundable except where the product was defective or incorrect on dispatch.
21. Defective or incorrect products
If you receive a defective or incorrectly printed product, contact us within 7 days of delivery. CannagarZA will replace the product or issue a full refund, including return shipping costs, at the buyer’s election.
